Speeding Traffic Violations and ORS 811.111 in Oregon
Traffic Violations under ORS 811.111
In Oregon, ORS 811.111 addresses the offense of violating a speed limit. The penalties for such violations can include fines and, in severe cases, suspension of driving privileges.
Challenging Radar Evidence under ORS 810.420
When it comes to challenging a speeding ticket based on radar evidence, ORS 810.420 outlines the requirements for the use of speed measuring devices. According to this statute, a police officer must have observed the recording of the vehicle's speed or have probable cause based on information from another officer who observed the speed. Additionally, the officer must have completed a training course approved by their law enforcement agency.
Filing a Pretrial Motion to Dismiss
To challenge the radar evidence, our attorneys may file a pretrial motion to dismiss questioning the compliance with ORS 810.420.
ORS 810.420 notes:
“(1)When the speed of a vehicle has been checked by a speed measuring device, the driver of the vehicle may be stopped, detained and issued a citation by a police officer if the officer is in uniform and has either:
(a)Observed the recording of the speed of the vehicle by the device; or
(b)Probable cause to detain based upon a description of the vehicle or other information received from the officer who has observed the speed of the vehicle recorded.
(2)A police officer may not issue a citation based on a speed measuring device unless the officer has taken and passed a training course, approved by the law enforcement agency that employs the officer, in the use of the speed measuring device." (https://oregon.public.law/statutes/ors_810.420)
Filing a Pretrial Motion to Dismiss
To challenge the radar evidence, our attorneys will review the evidence and may file a pretrial motion to dismiss questioning the compliance with ORS 810.420. However, ever case is different and a review of your case can determine if this may be the appropriate way to proceed.
